TERMS & CONDITIONS OF SALE
1. Scope:
These Terms apply to all quotations and services provided by North Incoming Service S.L. (NIS). Specific conditions for each booking are detailed in the Service Agreement attached to the quotation.
2. Nature of Services:
NIS may act as a direct provider (guides, coordination, transfers) or as an intermediary between the client and independent suppliers (hotels, restaurants, transportation companies, etc.).
When NIS acts as an intermediary, responsibility for the proper delivery of the service lies directly with the final supplier, without prejudice to NIS’s duty of due selection, coordination, and management.
3. Prices, Validity, and Payment:
Prices include only the services expressly listed in the quotation.
Unless otherwise stated, quotations are valid for 14 days from the date of issue and may be subject to change if suppliers modify their prices or conditions before confirmation.
Payment terms and deadlines are defined in the Service Agreement. Bank charges, international transfer costs, and compliance with EU Regulation 2015/847 are the client’s responsibility.
Failure to comply with payment deadlines may result in cancellation of services without refund of amounts already paid.
4. Cancellations:
Cancellation conditions are specified in the Service Agreement and depend on supplier policies. No refunds will be issued for unused services or late cancellations.
If NIS must cancel services due to supplier failure, force majeure, or safety concerns, alternatives or recoverable refunds will be offered whenever possible.
5. Program Modifications:
For operational, regulatory, weather-related, or safety reasons, NIS may modify itineraries, schedules, or services, providing equivalent alternatives whenever reasonably possible.
6. Exclusions:
Unless expressly included, the following are excluded: personal expenses (minibar, laundry, tips, etc.); meals or services not listed; travel documentation (passports, visas); additional hotel services requested directly by participants; delays or incidents unrelated to services arranged by NIS.
7. Liability:
NIS complies with Spanish tourism regulations and holds the required insurance and licenses. NIS is not liable for:
- acts or omissions of independent suppliers when acting as an intermediary;
- delays, changes, or cancellations caused by force majeure or unavoidable and extraordinary circumstances (severe weather, strikes, civil unrest, natural disasters, government restrictions, etc.);
- damages arising from participant negligence or failure to follow instructions.
NIS’s liability, when applicable, is limited to the amount paid for the affected services.
8. Claims:
Any claim must be submitted in writing within 8 days of the completion of the services. Claims submitted after this period may not be accepted due to supplier policies.
9. Data Protection:
Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Data may be shared only with suppliers strictly necessary for the execution of the contracted services.
10. Governing Law:
These Terms and any related contracts are governed by Spanish law. Any disputes will be resolved by the courts of Bilbao, Spain, unless mandatory consumer regulations require otherwise.
